At Nail Nation Pty Ltd ("Nail Nation”), we believe in Press. Slay. Repeat - empowering women to look and feel unstoppable. And because being straight up matters, these Terms and Conditions (“Terms”) set out everything you need to know about using our website and purchasing our products. 

 

These Terms govern your use of the Nail Nation website and your purchase of products from us. If you do not agree, please do not use the Nail Nation Website.

 

1.     DEFINITIONS USED IN THESE TERMS

 

1.1      Change of Mind: A request for a refund based on personal preference, not due to the Nail Set being an Incorrect Item or Damaged Product.

 

1.2      Damaged Product: A product that arrives broken, faulty, or defective due to manufacturing or transit issues, not caused by customer handling.

 

1.3      Incorrect Item: A product was delivered that does not match the order placed.

 

1.4      Nail Set: A single set of nails purchased from our website.

 

1.5      Nail Nation Website means the website located at https://www.nailnation.com.au

 

2           ABOUT US 

 

2.1      Nail Nation Pty Ltd (ACN 693 216 983) operates from Perth, Western Australia.

 

2.2      We are GST registered and sell nail products via our Shopify store at our Nail Nation Website.

 

3           ELIGIBILITY TO PURCHASE

 

3.1      To place an order on the Nail Nation Website, you must be at least 18 years old and legally capable of entering into binding contracts under Australian law.

 

4           ORDER PROCESS AND CONTRACT FORMATION

 

4.1      Orders are confirmed via email with an order number.

 

4.2      A binding contract is formed when we send a dispatch confirmation with an order number.

 

4.3      We reserve the right to reject any order due to stock issues, pricing errors, force majeure events or payment authorisation failure.

 

5           PRODUCT INFORMATION AND IMAGERY

 

5.1      Product images are for illustrative purposes only.

 

5.2      Colours of nail sets may vary due to screen settings.

5.4      We strive for accuracy in descriptions but cannot guarantee error-free content.

 

6           PRICING AND PAYMENT

 

6.1      All prices are listed in Australian dollars and include GST.

 

6.2      Prices may change without notice.

 

6.3      Accepted payment methods include credit card, PayPal, and other options available at checkout at the Nail Nation website located at our Nail Nation Website

 

6.4      Payment must be received before dispatch of Nail Nation products.

 

7           SHIPPING AND DELIVERY

 

7.1      Orders are typically dispatched within 48 hours.

 

7.2      You will receive a tracking number via email once your order ships.

 

7.3      We are not responsible for delivery delays caused by third-party couriers.

 

7.4      If incorrect address details are provided, we are not liable for lost orders.

 

7.5      Unclaimed parcels returned to us will incur redelivery fees.

8           CANCELLATIONS AND CHANGES

 

8.1      Orders are processed automatically and may not be cancelled once dispatched.

 

8.2      If you wish to cancel, contact us immediately at contact@nailnation.com.au. We will try to assist, but we cannot guarantee changes.

 

8.3      If cancellation is approved, shipping costs and a processing fee of $3.95 may be deducted from your refund.

 

9           REFUNDS

 

9.1      Refunds are available for:

 

a.     Damaged Products.

b.     An Incorrect Item.

c.     Change of Mind.

 

9.2      Refund Limit: Only one Nail Set per order can be refunded, regardless of the number of sets purchased or whether or not the nail sets have been opened.

 

9.3      Refunds apply to the Nail Set product price only. Shipping costs are non-refundable.

 

9.4      Refunds for Change of Mind purchases are subject to a processing fee of $3.95, which will be deducted from the refund amount for the Nail Set to cover transaction and handling costs.

 

9.5      Refunds only apply for unworn and unused Nail Sets that are still in their original condition and packaging.

 

9.6      Any refund will be made to your original payment method and will be processed within 14 days of receiving the returned Nail Set.

10        CONSUMER RIGHTS

 

10.1   These do not override your rights under the Australian Consumer Law.

 

10.2   You may be entitled to a refund, repair, or replacement for products that fail to meet consumer guarantees under Australian Consumer Law.

 

11        INTELLECTUAL PROPERTY

 

11.1   All content on our website including images, logos, trademarks, and text, is protected by copyright.

 

11.2   You may not reproduce or use any content without written permission by Nail Nation.

 

12        LIMITATION OF LIABILITY

 

12.1   We are not liable for any loss or damage arising from:

 

a.     Use or misuse of our products.

b.     Errors or omissions on our website.

c.     Delays or failures in delivery beyond our control.

 

13        DISCLAIMER

 

13.1   Nail Nation Australia makes every effort to ensure that the information presented on our website is accurate and up to date. However, due to the dynamic nature of the market and external factors beyond our control, we reserve the right to modify or withdraw any product, pricing, or promotional offer at any time without prior notice.

 

13.2   While we strive for accuracy, the content on our website, including product descriptions, images, pricing, availability, and specifications, may occasionally contain typographical errors, inaccuracies, variations or omissions. We reserve the right to correct such errors and to update or change information at any time without liability.
